Judge denies soldier-rapper's request for US court-martial

Chief Federal District Court Judge William T. Moore Jr. on Wednesday denied a 3rd Infantry Division soldier's petition for a temporary restraining order against moving him to Iraq. Spc. Marc Hall, of Coward, S.C., faces court-martial proceedings there on charges he made threatening comments to commanders and soldiers in his unit in a hip-hop song. Attorneys for Hall petitioned the Southern Federal District Court Monday, claiming the soldier's transfer to Iraq violated his constitutional rights to a fair trial. By denying the temporary restraining order, the district court ruled it was bound by long-standing precedent in abstaining from court-martial proceedings against service personnel.
